Retention of Title
Ownership of the artwork remains with the Artist (Bronwyn Waipuka-Callander) until full payment is cleared. Risk of loss or damage passes to the Buyer upon dispatch from the Artist’s premises, to the extent permitted under New Zealand law.
For clarity, all purchases are made by the Buyer as the contracting party. The Buyer accepts responsibility for the purchase decision, including delivery arrangements and any nominated recipient.
Studio Pick-up
All purchased artworks (including NIU Maori Oracle) are available for collection by appointment at Suite 4/42 Henderson Valley Road, Henderson, Auckland.
Auckland Delivery
Free Personal Delivery -- Available for all purchased artworks (including NIU Maori Oracle) within the "Henderson Valley area" (5-7km radius from Suite 4/42 Henderson Valley Road, Henderson (via GPS maps)). Dispatch will be on **Monday (mid morning)**. Please Note: For addresses outside this local zone, please refer to the courier shipping terms below.
Any other personal delivery outside the 5-7km radius is available solely at the discretion of the Artist.
Courier Shipping
Prints (A5 & A4) with Matt board, and NIU Maori Oracle decks and Guide Book -- Estimated prices as specified.
* Delivery addresses are required prior to final purchase in order to provide exact shipping costs.
* North Island: Overnight courier (Rural: please add 1–3 days).
* South Island: Economy courier (Rural: please add 1–3 days).
* Dispatch: Orders are processed and shipped from the Artist’s studio on **Monday (mid morning)**.
Special Shipping (POA)
Special Shipping refers to any item that falls outside the standard, automated courier service for flat A5-A4 Matt board prints or NIU. This includes oversized artworks (A3,A2-A1), glass-framed pieces, sculptures, and canvases.
* Price on Application (POA): Postage costs are not included in the initial purchase price.
* Process: A custom shipping quote can be sourced based on the delivery location and the specific dimensions of the artwork.
* Confirmation on any additional shipping costs will be communicated before dispatch.
International Shipping
Sorry, no international shipping is available at this time.
Items will be posted to the address provided in the purchase order, at the Buyer's cost, within a reasonable timeframe after the purchase is accepted.
While every effort is made to dispatch within the stated timeframes, please note that delays can occur due to courier constraints or unforeseen circumstances, and the Artist is not liable for late delivery.
The Artist is not responsible for incorrect or incomplete addresses provided by the Buyer.
** Couriered and POA shipped items are dispatched at the Buyer’s risk. However, where required under the Consumer Guarantees Act 1993, the Artist remains responsible for ensuring the goods are delivered in acceptable condition. The Buyer is responsible for lodging any courier claims where appropriate, and the Artist will provide reasonable assistance with such claims where required.**
For personal delivery within the 5-7km radius of the Artist’s studio, the Buyer explicitly authorises the Artist or their agent to leave the artwork in a designated 'safe place' at the delivery address if there is no one at the premises, unless specific alternative instructions are provided by the Buyer prior to purchase. Deliveries are conducted on Monday mid morning only; no afternoon or after-hours deliveries are permitted due to Auckland traffic. A 'safe place' is defined as a weatherproof, secure location out of direct street view.
* Proof of Delivery: Upon leaving the artwork or item, the Artist or their agent will take a photograph of the artwork in situ and email this proof of delivery to the Buyer.
* Transfer of Liability: Once the artwork or item is placed in the 'safe place' and the photographic evidence is sent, all risk of loss, theft, or weather damage transfers immediately to the Buyer. The Artist accepts no liability for items stolen or damaged after this point. If the Buyer requires a personal signature or wishes to be present for delivery, they must specify this with the Artist prior to dispatch; otherwise, authority to leave is assumed upon purchase.
All Returns at Buyer's Expense
The Buyer is responsible for return shipping costs, except where required under the Consumer Guarantees Act 1993, including where goods are faulty, damaged on arrival, or not as described.
Condition for Return
To be eligible for a refund or exchange, all returned artwork must be in its "original condition", including the original packaging and any accompanying documentation.
Non-Returnable Items & Disputes
The Artist reserves the right to refuse a return or refund in the following instances:
* Change of Mind: Returns initiated solely because the Buyer has changed their mind.
* Transit Damage: If the artwork arrives damaged, please contact the Artist as soon as possible. The Buyer may then be directed to lodge a claim with the courier or their insurance provider, subject to the Consumer Guarantees Act 1993 where applicable.
* No Fault Found: If, upon inspection by the Artist or their agent, the artwork is found to be undamaged, not defective, and as described.
